GENERAL TERMS - CONSUMER

These general terms ("Terms") apply to the purchase and use of products and services from Fileservice Scandinavia AB, reg. no. 559560-6251 ("Revtech"), by private individuals ("Consumer"). The Consumer's statutory rights under mandatory consumer protection law are not limited by these Terms.
1. Scope
The Terms apply to purchases of Machines/equipment, access to the Portal, Credits, files/software, support and related services ("Services").
2. Master and Slave machines
2.1 Master: A Master machine is not technically tied to Revtech under the manufacturer system and can be used with other suppliers.
2.2 Slave: A Slave machine is technically and permanently linked to Revtech under the manufacturer system and can only be used through Revtech. This is disclosed before purchase.
2.3 The Consumer understands that a Slave machine cannot be transferred to another file supplier or released from Revtech without the approval of the manufacturer and/or Revtech, to the extent this is technically possible.
3. Ordering and delivery
3.1 Ordering may be made via web, email or phone where applicable.
3.2 Delivery times are estimates and may vary.
3.3 Revtech cannot guarantee compatibility with all vehicles, all ECU/TCU versions or all software revisions.
4. Compatibility, availability and limitations
4.1 Not all programming, functions, unlocks, protocols and modifications are available for all vehicles/models/control units.
4.2 Technical limitations may depend on vehicle condition, software version, hardware, access method (OBD/Bench/Boot) and manufacturer systems.
5. Power figures and results
5.1 Performance gains and figures in guides or other materials are indicative and based on tested vehicles. Results may vary between vehicles. No specific gains or outcomes are guaranteed for the Consumer's vehicle.
5.2 Revtech provides no warranties regarding performance, fuel consumption, emissions, durability or other outcomes.
6. Digital services and Credits
6.1 Credits are purchased in advance and consumed when used/ordered in the Portal.
6.2 Consumed Credits and digital services are normally non-refundable. If the Consumer has expressly consented to the delivery of digital content or a digital service starting during the withdrawal period and has at the same time acknowledged that the right of withdrawal may thereby be lost, the right of withdrawal ends to the extent provided by applicable law.
6.3 In case of technical errors affecting the credit balance, Revtech shall correct the balance without undue delay.
7. Right of withdrawal for distance purchases
7.1 For distance purchases within the European Union, a 14-day right of withdrawal normally applies under applicable consumer protection legislation.
7.2 If Revtech does not provide correct withdrawal information, the withdrawal period may in some cases be extended.
7.3 For digital content/digital services, the withdrawal right may be affected if the Consumer expressly consents to service start during the withdrawal period and acknowledges that the withdrawal right may end once delivery is completed, to the extent allowed by law.
7.4 When exercising the right of withdrawal for Machines or other physical equipment, the Consumer is responsible for the cost of return shipping, unless otherwise required by mandatory law.
7.5 For Consumers outside the European Union, no right of withdrawal or open-purchase policy applies except where such rights are required under mandatory law in the Consumer's country of residence.
8. Consumer responsibility and risk
8.1 The Consumer is responsible for ensuring the vehicle is in a technical condition that permits the measures, that correct instructions are followed, and that backups are made where applicable.
8.2 Programming and use of machine/software involve risks. Revtech cannot guarantee that a specific function or result can be achieved on a specific vehicle.
8.3 Revtech is not liable for damage caused by vehicle condition, incorrect programming/installation, insufficient data, external factors, or other circumstances outside Revtech's control.
9. Legality and regulatory compliance
9.1 The Consumer is responsible for ensuring that ordered or used programming/functions are lawful and permitted under applicable law and authority requirements in the relevant country.
9.2 Revtech is not responsible for software usage and assumes no responsibility for use in breach of law or regulation, including without limitation functions that may affect emission-related systems such as AdBlue/SCR, DPF, EGR or similar.
10. Defects, complaints and remedies
10.1 Defects are assessed under the Swedish Consumer Sales Act and the Consumer has the rights granted by law.
10.2 If delivered software contains defects attributable to Revtech's work, Revtech undertakes to deliver corrected software or, where applicable, re-credit equivalent value as Credits. This does not affect statutory consumer rights.
11. Licenses and third-party fees
11.1 Certain Machines and functions may require license renewals, annual fees, upgrades or manufacturer fees charged by third parties. Such costs are borne by the Consumer.
11.2 Revtech is not responsible for third-party terms or price changes.
12. Intellectual property and unauthorized distribution
12.1 Revtech files/software may not be copied, shared, distributed, resold, published or otherwise made available to third parties.
12.2 Reverse engineering, strategy extraction and building a competing database based on Revtech materials are prohibited. Unauthorized use may lead to legal action.
13. Confidentiality
All non-public information regarding Portal, systems, pricing/credit structure and internal communication is confidential and must not be disclosed to third parties.
14. Payment and default
In case of unpaid invoice, Revtech may, after normal handling, temporarily suspend account/Portal and related services until payment is made.
15. VAT and international sales
15.1 Prices are stated including or excluding VAT as shown at the time of purchase.
15.2 For sales to Consumers within the European Union, the applicable VAT rate may be determined based on the Consumer's country of residence or delivery country in accordance with applicable VAT rules.
15.3 Revtech may charge and report VAT according to applicable national rules, including through the One Stop Shop (OSS) scheme or an equivalent system.
15.4 If the Consumer provides incorrect or incomplete information regarding address, country of residence or other information affecting the VAT treatment, the Consumer is responsible for the consequences arising from this to the extent permitted by law.
16. Liability
16.1 Revtech is not liable for indirect losses to the extent permitted by mandatory law.
16.2 These Terms do not limit Consumer rights under mandatory consumer protection law.
17. Disputes
17.1 The Consumer may file a claim with the Swedish National Board for Consumer Disputes (ARN).
17.2 Swedish law applies, without limiting the Consumer's right to any mandatory consumer protection that applies under the law of the country where the Consumer has their habitual residence.
17.3 If the Consumer has their habitual residence in another EU/EEA country, the choice of Swedish law does not affect mandatory consumer protection rules applicable in the Consumer's home country that cannot be contractually waived.
